1.a. Kiboko Safaris, Private Bag 295, Lilongwe, Malawi (herein after called the Company), accepts bookings for all tours as described and printed in the current folder and on their website subject to the following conditions.

1.b. The person signing and returning the Booking Form (herein after called the Client) accepts these conditions.

2. No contract shall exist between the Company and the Client until the completed Booking Form and the deposit of 20% of the tour price have been received by the Company and the Company has confirmed the booking to the Client.

3. Information given in all folders, brochures, leaflets, websites and advertising is given in good faith by the Company at the time of print, but unless specially stated, shall not form any part of the contract.

4. It is the responsibility of the Client to be in possession of a valid passport, visa, permits and certificates as may be required for the tour. The Company does not accept responsibility for changes in regulations for visas or any particular requirements for visas. The Company can not be held responsible for the failure of the Client to obtain the necessary visas*.
* Visa Exemptions for entry into Zambia can be arranged if the Safari is booked by the client and confirmed by the company, more than one week in advance. However whilst every effort is made to waiver the clients visa it has to be understood that if the Zambia Immigration officials in charge reject, change or admit no knowledge of the waiver, any resultant cost will be the clients to bear.

5. The Client must take all necessary inoculations as required or generally recommended in relation to the countries to be visited.

6. The Client will comply strictly with all the laws, customs and foreign exchange restrictions of any country visited. If the Client breaks those laws or is detained by the local authorities for an alleged breach of those laws, the tour may proceed without the Client. The Company shall not be responsible or liable for any Client who contravenes any law or regulations of any country visited.

7.a. The client making any booking will, by the making of such booking, warrant that he or she has authority to enter into a contract on behalf of other person(s) included in such a booking and in a event of the failure of any or all of the other persons so included to make payment, the person making the booking shall by his or her signing of the bookings form assure personal liability for the total price of all bookings make by him or her.
7.b. Changes or amendments to the Client’s booking will incur a 50 US Dollar charge per amendment. Any request received less than 10 days before departure of the original booking will be treated as a cancellation. All requests for amendments must be in writing and signed by the Client, and takes effect from the date received by the Company.

8. Should a Client wish to cancel a booking, the cancellation will take effect from the date the Company receives written notification.
The cancellation charges will be none if the cancellation is received more then 8 weeks prior to the departure.
The cancellation charges will be the full amount of the deposit if the cancellation is received by the between Company 8 weeks and 2 weeks before the departure date.
The cancellation charges will be the deposit payment and the full payment due if the cancellation is received by the company 2 weeks or less before the departure date.

9. The Client shall pay the balance of the tour price, to the legal appointed representatives of the Company not any later than the pre departure meeting of the safari.

10. The Company shall determine a minimum number of persons required for the tour to take place and reserves the right to cancel the tour and notify the Client not less than 10 days before departure date, if the minimum number is not enrolled. The Company will refund in this case all sums paid by the Client or the Client shall be entitled to accept a substitute tour of equivalent or higher quality where the Company is able to offer the Client a substitute or if a lower quality a refund of the difference in price.

11. The conveyance of the Client; his luggage and personal property during the tour by any carrier, other than the Company, is subject to the terms and conditions of such carrier, and if by the Company, these conditions. If inadvisable, due to circumstances beyond the Company’s reasonable control the Company may at any time cancel the remainder of the tour or section of it or modify any tour itinerary or route as it sees fit. The Client shall be bound by any cancellation or alterations made under the provisions of this clause and shall not be entitled to recover any sum paid by him unless the whole tour is cancelled prior to commencement. The final decision on the itinerary and the conduct of the tour will be taken by the tour leader or an appointed legal representative from the Company, and will be in the interests of the tour group as a whole. The Client will accept the authority of the tour leader as appointed by or on behalf of the Company or the Company’s legal appointed representative.

12. Before the Client commences a tour he or she must obtain travel insurance with a reputable insurer to cover personal injury, medical expenses, repatriation expenses, loss of luggage and the expenses associated with the cancellation or curtailment of the tour. The Client is responsible for any loss or damage or personal possessions or any consequential loss resulting there from. If a Client becomes ill, all hospital expenses, doctor’s fees and repatriation costs are the Client responsibility and the Company shall not be liable for any refund of the tour fare.

13. Prices quoted in the Company’s price list attachment were correct at the time of printing. However as external factors may effect the exchange rates, transportation taxes, operational and administrative costs, we reserve the right to increase the price up to the day of departure. If after departure additional expenses are incurred through delay, accident or disruption of advertised scheduled beyond the control of the Company, such expenses must be born by the Client.

14. All tours and associated arrangements are subject to alteration without notice if necessary because of factors beyond the Company’s control including, but not limited to exchange rates changes, political disputes, border closures, climatic variations, airline departure time changes, although where possible, details of such alterations will be sent to the Client’s last known address as soon as the Company is aware of such alterations. The Company reserves the right to alter itineraries if it is in the interest of the Client to do so.

15. If the Company considers the Client as unsuitable for a tour it may in its absolute discretion cancel such Client’s booking or decline to carry the Client further.

16. Whilst the Company will take all reasonable precautions to provide for the Client’s safety and comfort, the Client accepts that these tours and optional activities carry inherent risk and any Client wishing to participate in such activities must be able to assume this risk. The Client must be in good health. Neither the Company nor it’s agent shall be liable for the personal injury, damage or loss including consequential loss to any Client howsoever caused including personal injury, sickness or death caused or contributed to by the negligence, breach of contract or duty to the Company’s servants, agent or any independent contractor.

17. If the Client has any complaint about the tour booked he or she should first bring this to the attention of the tour leader. If at the end of the tour, the Client feels that his or her complaint has not been properly dealt with, the Client must notify the Company in writing within 30 days of completion of the tour.

18. No person or organization has any authority to change or alter any of the above conditions, information or itineraries on behalf of the Company.
